1. Introduction & Acceptance

These Terms & Conditions (the “Terms”) govern your access to and use of Prosopeion (the “Service”), an online application operated by Dun Hound Studios (“we”, “us”, or “our”). By creating an account, registering, or otherwise accessing or using the Service in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any policies referenced in them.

Prosopeion is a separate software product. Dun Hound Studios’ commissioned maps, writing, layouts, and published creative work remain human-made. Prosopeion uses generative AI to let users interact with campaign material they provide or create in the Service.

If you do not agree with these Terms in full, you must not access or use the Service. Your continued use of the Service constitutes ongoing acceptance of the Terms as they may be updated from time to time.

2. Eligibility

You must be at least eighteen (18) years of age and have the full legal capacity to enter into a binding agreement in order to use the Service. By using the Service, you represent and warrant that you meet these requirements. We do not knowingly permit the Service to be used by anyone who does not meet them, and we may suspend or terminate any account where we believe this requirement is not met.

3. Accounts & Registration

To use certain features you must register for an account. You are solely responsible for the accuracy, completeness, and lawfulness of all information you provide during registration and at any time thereafter. You agree not to provide any information that is false, misleading, or that you do not have the lawful right to provide.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your credentials.

4. User Content & AI-Generated Content

The Service allows you to submit input — including prompts, character and NPC data, messages, images, and other materials (collectively, “User Content”) — and to generate output using artificial-intelligence models. You are solely responsible for all User Content you submit and for everything you generate, request, or do using the Service.

You represent and warrant that your User Content, and your use of it, is lawful and does not infringe, misappropriate, or violate any third party’s intellectual property, privacy, publicity, or other rights, and does not breach any applicable law or regulation.

The Service relies on third-party artificial-intelligence models (including Google Gemini). AI-generated output may be inaccurate, incomplete, offensive, or otherwise unsuitable, and may not reflect real people, facts, or events. Output is provided for entertainment purposes only, does not constitute professional advice of any kind, and you rely on it entirely at your own risk. You are solely responsible for how you use, interpret, publish, or distribute any output.

5. Acceptable Use & Prohibited Conduct

You agree not to use the Service to, and not to permit or enable any third party to:

• engage in, promote, or facilitate any unlawful activity or submit any content that is illegal under any applicable law;
• infringe or misappropriate the intellectual property, privacy, or other rights of any person;
• generate or distribute content that is abusive, harassing, defamatory, hateful, sexually exploitative, or otherwise harmful;
• attempt to gain unauthorized access to, disrupt, overload, or impair the Service or its underlying systems;
• reverse-engineer, scrape, or circumvent any security, rate-limiting, usage quota, or access control of the Service; or
• use the Service in any manner that violates these Terms or any applicable law.

To the maximum extent permitted by applicable law, we are not responsible for, and expressly disclaim all liability arising from, any misuse of the Service by you or by any third party.

6. Responsibility for Unlawful Content

You acknowledge and agree that you alone are responsible for the legality of any information or content you provide to or generate through the Service. If any such information or content is unlawful, that is your sole responsibility, and to the maximum extent permitted by applicable law we bear no liability whatsoever for it. We do not monitor, endorse, or assume any obligation to review User Content, but we may, at our sole discretion and without notice, remove any content and suspend or terminate any account that we believe violates these Terms or any applicable law.

7. Third-Party Services

The Service depends on third-party providers to function, including, without limitation, Supabase (authentication and data storage), Google Gemini (artificial-intelligence generation), Stripe (payment processing), and Cloudflare (security and anti-abuse). Your data may be processed by these providers as necessary to deliver the Service, and their handling of your data is governed by their own terms and policies. To the maximum extent permitted by applicable law, we are not liable for the acts, omissions, availability, or security of any third-party provider.

8. Subscriptions & Billing

The Service offers free and paid subscription tiers with differing features and usage limits. Paid subscriptions are billed through Stripe on a recurring basis and renew automatically until cancelled. By subscribing, you authorize us and our payment processor to charge the applicable fees to your payment method.

Except where required by applicable law, fees are non-refundable, and partial periods are not refunded on cancellation. We may change pricing, tiers, features, and usage limits at any time; changes will apply prospectively. It is your responsibility to manage and cancel your subscription before a renewal if you do not wish to be charged.

9. Security & Data Breaches

We implement reasonable technical and organizational measures to protect the Service. However, no online service is completely secure, and we do not warrant that the Service or your data will be free from unauthorized access, interruption, or loss. To the maximum extent permitted by applicable law, we are not liable for any unauthorized access to or use of the Service, any hacking, security breach, or other malicious activity, or any resulting loss, corruption, or disclosure of data. You are responsible for maintaining your own copies of any content that is important to you.

10. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any output will meet your requirements.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event will Dun Hound Studios, its owners, or its affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to your use of, or inability to use, the Service.

To the maximum extent permitted by applicable law, our total aggregate liability for any and all claims relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the claim, or (b) fifty euros (€50). Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law, including your mandatory rights as a consumer.

12. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Dun Hound Studios and its owners and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your User Content, your use of the Service, or your breach of these Terms or of any applicable law.

13. Suspension & Termination

We may suspend, restrict, or terminate your access to the Service at any time, with or without notice, including where we reasonably believe you have violated these Terms or any applicable law. You may stop using the Service at any time. Provisions that by their nature should survive termination — including ownership, disclaimers, limitations of liability, and indemnification — will survive.

14. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Service after any change takes effect constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

15. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Greece, without regard to its conflict-of-law rules. The courts of Greece will have jurisdiction over any dispute arising out of or relating to these Terms or the Service. Nothing in this section deprives you of the protection of any mandatory consumer-protection provisions of the law of your country of residence.
